TERMS AND CONDITIONS

These terms and conditions are undertaken upon the confirmed entry in to the event between the participant(s) and Cannonball World Events LLC whereby “Organizer” means Cannonball World Events LLC; “You” means participants and all those persons listed on the entry form and/or taking part in the event; “The Event” means The Great American Run 2008. These rules and your participation in the event are governed by US law, and you submit to the jurisdiction of the US courts.

The Great American Run is not a race.

1/ WARRANTIES AND MANDATORY REQUIREMENTS
You must hold a current valid driver’s licence (and a valid passport for non-US residents only), and you must be over the age of 18 years. You acknowledge that you abide by the liquor laws of each state and if under the age of 21, understand that you may be refused entry in to certain venues in which case no refunds or compensation will be given.
You must not compete with other drivers in any manner. In particular, you must not race with other drivers. You must not place any bets of any kind in relation to the event. You must drive safely and with proper courtesy to all other participants and members of the public. You must comply with all applicable laws and regulations whilst in the states visited. Including without limit, all applicable laws of road and traffic in force at the time, the laws relating to the road worthiness of your vehicle and the laws relating to the possession, or importation of prohibited substances, illegal immigrants, goods or offensive weapons or criminal offences of any kind. If you are refused passage and/or entry/exit to or from any state visited en route, any additional cost incurred is your own responsibility. Please note that ANYONE caught racing on the public highway in any state on route, will be excluded from further participation in the event immediately. No refunds will be made, and all privileges will be withdrawn (i.e. hotels and entry to parties).
You must conduct yourself appropriately at all times and in accordance with the rules of the hotels and other venues used during the event.
You must not drive at any time whilst under the influence of alcohol, drugs or any other intoxicating substances. You must not consume any illegal intoxicating substance at any time. You will be refused further participation in the event if you breach of any of these terms and conditions or refuse to follow the instructions given to you during the event by the organizers. In such cases no refunds will be given.

2/ THE EVENT
Your entry into The Great American Run will be granted when the organizers receive returned copies of your driving licences and car insurance documents, a signed, completed entry form and waiver along with the appropriate entry fee and you have received a payment receipt from the Organizers. The organizers reserve the right to refuse any application for entry without giving any reason. The entry fee in to the event does not include personal acquisitions, petrol (gas), telephone bills or other expenses and disbursements incurred while staying in the hotel (including courier/postal charges relating to sending left luggage with you), fines of any sort, or damage caused at any venue visited, which you will be responsible for paying to the organizer in addition to the entry fee within 30 days of receipt of an invoice from the organizer. The organizers reserve the right to change any locations or dates of the event at any time. The Event Directors decision is final in any dispute or discussion.

3/ PAYMENT / CANCELLATION
A deposit of $2000 is required to reserve your place with the remaining 50% deposit due by 31 March 2008 and the final 50% payment to be received by 07 June 2008. A $2000 discount will apply to all bookings that are paid in full at the time of booking before 07 June 2008. Late payments will incur an administration charge of $400, cancellation of the booking or refusal to the event without refund. Please contact the organizers for bank details if you wish to send payment by money transfer which will incur a $25 per transaction charge. Credit/debit card payments will incur a 3% surcharge. Payments may be made with US dollar check payments without incurring any surcharges. The organizers reserve the right to cancel or postpone the event or any part thereof should circumstances arise. If it proves necessary for the organizer to cancel the event, a full and immediate refund will be issued or where possible an alternative date offered. In the event of a natural disaster, flood, fire, strike, other acts of God, outbreak of civil war, or in the case where the event or the route, or any part of the route, cannot be completed for any reason but not limited to the prevention of the entry in to any state, or any other circumstances which in the Organizer’s opinion forces them to suspend or terminate the Event, the company will not be liable for the refund of the entry fee or any part thereof. After the commencement of the event the organizer will not make any refund of the entry fee or pay compensation to you if you are unable to continue in the event for any reason whatsoever. You acknowledge that the route of the event is very demanding and if you do not manage to complete any part of the route and/or are unable to stay at the provided venues for any reason whatsoever you will not be entitled to a refund of any part or the entire entry fee. The organizers reserve the right to refuse participation in, or to cancel the event, at any time for any reason whatsoever (without being obliged to disclose the reason). In case of refusal to allow you to participate or your refusal to supply the organizer with the necessary documentation, no refunds of the entry fee will be made. Upon entering the event, the venues are hired and dropping out does not entitle you to any compensation regardless of circumstance therefore it is your responsibility to take any relevant insurances to cover your losses under such circumstances. If you decide to cancel your entry then written confirmation must be sent by the person who has signed the entry form and will result in the loss of the full entry fee.

4/ INSURANCE / LIABILITY
You are responsible for ensuring that vehicles used in the event are properly licensed and insured for use on the public highways in all states and that you have at minimum, collision damage waiver cover for the entire event. You confirm that you obtained appropriate insurance for your participation, including without limit, life insurance, personal injury and third party insurance, and insurance of your vehicle and your other possessions. Travel insurance is not included in the entry fee. You are responsible for ensuring that you have mechanical breakdown recovery insurance for your participation in the event. The organizers accept no responsibility for repatriation of you or your vehicles regardless of circumstance. The organizers offer a luggage van service (which must be prebooked in advance of the event start date) however this service is offered at your own risk. The organizers exclude all liability in any accident/damage/delay or loss of possessions. The organizers exclude all liability in any accident caused by or to you and your vehicles during the entire event. The organizers also exclude any liability for any breach of the laws and regulations of any state. You shall be held responsible for any accident or breach of the laws in which you may be involved and shall immediately disclose forthwith to the organizers particulars of any such incident from which liability may arise and shall have no claim against the organizers arising out of any act or omission of the organizers, their servants, agents or officials during the course of the event. The organizers exclude any responsibility from any services or products offered or supplied by third party companies.

5/ PROMOTION
You agree to have The Great American Run logo and sponsors stickers attached to your vehicle in the specified positions for the entire duration of the event. Stickers are non-permanent and easily removable without damaging paintwork. The organizers accept no liability for damage to paint.
Personal sponsorship for your vehicle is not permitted without the organizers prior consent. The organizers reserve the right to refuse 'unauthorised' sponsored vehicles or individuals' entry to the event. Participation in the event will constitute consent to be photographed and to participate in the filming of footage documenting the event. You hereby grant the organizers permission to utilise and exploit your appearance in any and all manner and media throughout the world in perpetuity. You further agree that the organizers have the sole discretion as to whether any footage in which you appear is actually used by the organizer and that if the organizers do use such footage it may be edited at our sole discretion. You consent to the use of your name, likeness, voice and biographical material about you in connection with footage, publicity and related institutional promotional purposes. You expressly release the organizers, its directors, agents, employees, licensees and assigns from and against any and all claims which you have or may have for invasion of privacy, defamation or any other cause of action arising out of production, distribution, broadcast or exhibition of footage. All photographs and footage arising from the event and all copyright in those photographs and footage will remain the property of the organizers. You agree to your personal details being given to external companies for use as the organizers see fit.

6/ MEDICAL RESTRICTIONS
You will be driving in varied conditions and in changing climates, often for (very) long periods. If you have any medical conditions, which could be adversely affected by strenuous exercise or are in any doubts about your health, or taking any medication, you must get clearance from your doctors before returning the application form. Although you maybe fit to take part, there may be relevant medical information about which we should know e.g. allergic reactions, diabetes, epilepsy etc. It is important that we know about any potential problems.

7/ HOTELS
Hotels, where included as part of the entry fee, are offered subject to availability. The organizers reserve the right to alter hotel accommodations to that of an equivalent grade where necessary.

8/ SURCHARGES
The organizers reserve the right to apply a surcharge where currency fluctuations or other circumstances beyond our control deem this necessary.

9/ TRAVEL DOCUMENTS
You are responsible for ensuring that all travel documents required eg. passports, visas are valid and effective.

10/PRIZE FUND
The prize fund is a guaranteed $100,000 to the winner based on 1-199 cars starting the event on September 7th 2008 with the fund rising dependant on number of entrants. 200-299 cars is $250,000, 300-399 cars is $500,000, and 400+ cars is $1million.

11/ TERMS & CONDITIONS AND WAIVER
The organizers reserve the right to change these terms and conditions subject to notifying you of the changes. You shall be deemed to have accepted the amended terms and conditions by participating in the event. By participation in this event, made under the arrangements of the organizers you acknowledge the danger of any adventure travel activity, including but not limited to: Dangers in general road driving, driving on private roads and race tracks, travelling along mountainous roads, high altitude, forces of nature, civil unrest, terrorism, travel across water by hovercraft, ferry or similar, air travel, accident or illness without means for rapid evacuation or medical facilities.
You understand that in the event of suffering any personal injury or death (other than personal injury or death caused by negligence) or any damage being caused to any property that you will not bring any action or other proceedings against the organizer, its directors, agents, employees, licensees or assigns, the event sponsors, or any company or persons associated with the organizer. You agree to comply with all of the events terms and conditions of entry. You acknowledge and understand that the organizers will use reasonable efforts to ensure that all other participants abide by the terms and conditions of entry, but cannot guarantee that the participants will abide by these terms and conditions. You indemnify the organizer, its directors, agents, employees, licensees and assigns, and the event sponsors from all claims, demands, or expenses as a result of breaching these conditions, your negligence or otherwise arising out of your participation in the event. You acknowledge that there exist inherent risks in participating in an event such as The Great American Run event. Except for death or personal injury caused by negligence, which is not excluded or limited by anything in these Terms and Conditions of entry, the organizers, its officers and employees exclude all liability in relation to your participation in the event.
